KONSEP PEMBATALAN NORMA HUKUM : “STUDI PERBANDINGAN KONSEP NASIKH-MANSUKH MENURUT IMAM SYAFI’I DENGAN KONSEP JUDICIAL REVIEW DALAM HUKUM POSITIF”

Nasakh and Judicial Review is a theory that explains a legal rule relating to the concept of abrogating legal norms that originate in the basic law or the main source of law. This study takes the formulation of the problem of what factors that led to the birth of nasikh-mansukh according to Imam Syafi'i and judicial review in positive law and what are the similarities and differences nasikh-mansukh and judicial review. Writing this thesis is a type of normative legal research (normative legal research). Sources of primary legal material obtained from the Qur'an, as-Sunnah and the 1945 Constitution. While secondary legal materials obtained from books, journals, research results and supporting materials such as, while the author's legal material analysis using content analiysis or content and comparative study analiysis or comparison studies as well as suitability and alignment analysis. Based on the results of research and study of the authors obtained an answer that the factor causing the birth of nasikh-mansukh according to the view of Imam Syafi'I is that nasakh in the Qur'an is proof of God's grace is very wide for hambahnya in running the Shari'ah which Allah revealed. Imam Shafi'i acknowledges the existence of nasakh in Islam by explaining, Allah Almighty has revealed the book as a guide and a mercy to His hambah. In the book, Allah requires obligations, and Allah also has the right to abolish the obligations of others, for to give grace and looseness to His hush While equality of nasakh and judicial review is a theory of abrogation of legal norms, while the difference is nasakh is the product of God and judicial review of weak human products. The conclusion is that God's laws are more certain and wise while man-made laws have many faults and weaknesses. Suggestion, God's law should be far more important than human law
